Dispute Resolution Under AIA Documents and Dispute Resolution Trends


A little cloudy on how dispute resolution affects you and your company and what AIA A201 has to say about it? Join us at our December meeting where we will discuss the dispute resolution provisions in AIA Document A-201 and how they have changed in the new 2017 edition. We will investigate the various types of dispute resolution and discuss arbitration vs. litigation. We will delve into the mandatory mediation clauses under AIA A 101 to understand how mediation is a condition precedent to either litigation or arbitration and compare and contrast arbitration and mediation. Finally, we will look at resolution trends and discuss the increased use of mediation in recent years and how this has resulted in increase of settlements prior to trials or arbitration hearings.



Thomas R. Yocum, Esq. is managing member of the law firm of Benjamin, Yocum & Heather, LLC where he practices in the areas of law relating to construction, business, corporate, insurance, creditors’ rights, commercial litigation and arbitrations.  Tom earned his B.A. degree, summa cum laude, from Ohio State University in 1975 and his J.D. degree from the University of Cincinnati in 1979.  Tom regularly lectures on construction law.


Julie A Neuroth, Esq. serves in an Of Counsel capacity for Benjamin, Yocum & Heather, LLC with her primary focus in the areas of Construction and Business law. She also works with clients with other general civil practice issues.  She has extensive experience in negotiation, mediation, and other ADR processes and when necessary, litigation and trial experience in handling complex construction and other matters. Julie obtained her law degree from Salmon P. Chase College of Law where she served as an officer of the Student Bar Association and completed an internship with the Hon. William O. Bertelsman of the United States District Court for the Eastern District of Kentucky.
